Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. The information We collect includes, but is not limited to:
- Account information: email address, password (stored only in hashed form), language preference, and the verification code used to confirm Your email address.
- Profile information: display name, short biography, profile photograph or avatar, musical genres, instruments and skills, and any portfolio links You add (for example to a website, YouTube, Vimeo, or SoundCloud).
- Location information: the geographic coordinates of Your device or of a location You place manually, and the coordinates and optional street address of any Jam You create. See the Location Information section below, which explains this in detail.
- Content You create: chat messages You send to other users, posts You share with Your connections, ratings and written feedback You leave about other users, and the names, descriptions, images, and times of Jams You create.
- Connections and activity: Your matches and the approve or reject decisions You make in the match feed, friend requests You send or receive, Your connections, users You have blocked, Jam invitations, and Your attendance and check-ins at Jams.
- Device and technical information: push notification tokens, device identifiers, device and operating system type, IP address, and diagnostic and crash data.
- Reports and support requests: the content of any report You submit about another user or a Jam, any report another user submits about You, and any message You send to Our support or feedback channels.
- Usage Data, as described below.
We do not collect Your date of birth, Your telephone number, Your precise home address, or any payment or financial information. We do not knowingly collect special categories of sensitive personal data. Please keep in mind that any personal information You choose to put in Your biography, posts, or chat messages is collected as part of that content.
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.
Information Collected while Using the Application
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
Information regarding your location
Pictures and other information from your Device's camera and photo library
Photographs You select are uploaded to Our image hosting provider and used as Your profile avatar or Jam image, and are visible to other users. You can enable or disable access to Your camera, photo library, and location at any time through Your Device settings.
Location Information
Location is central to how InstaJam works, so We want to be specific about what We collect and who can see it.
What We collect
In Your location settings, You choose one of three options:
- Track my location. With Your permission, the Application reads Your Device's precise GPS position while the Application is open and in the foreground, and sends an update to Our servers when You have moved a meaningful distance (approximately 25 metres). We do not track Your location in the background or when the Application is closed.
- Set a location manually. You place a pin on a map, and We store only that point. Your Device's actual GPS position is not collected.
- Off. No location is collected, and any coordinates We previously stored for You are deleted from Our servers. Location-based features such as matching by distance and finding nearby Jams will not work.
We store Your location as a single current set of geographic coordinates associated with Your account. We do not keep a history of where You have been, and each update replaces the previous one.
What other users can see
- Your coordinates are never shown to other users. Our servers use them to calculate the approximate distance between You and another user, and it is only that distance (for example, "12 km away") that is displayed in match cards, search results, and recommendations. Your position is not shown on a map to other users.
- Please be aware that a distance shown from several different points can in principle be used to estimate where someone is. If this concerns You, use the manual pin option to set a general area rather than Your exact position, or turn location off.
- Jam locations are different. When You create a Jam, the coordinates You choose and any street address You enter are shown to other users, including as a pin on a map in Jam search. Do not enter an address You are not comfortable sharing.
Checking in to a Jam
If You check in to a Jam, the Application compares Your Device's current position to the Jam's location on Your device to confirm You are nearby. The fact that You checked in is recorded and is visible to other attendees, and it is what makes You eligible to rate the people You played with.
How to turn it off
You can change or disable location sharing at any time in the Application's location settings, and You can revoke the Application's location permission entirely in Your Device settings. Selecting the "off" option deletes the coordinates We hold for You.
Information Visible to Other Users
InstaJam is a social service, so some of Your information is shared with other people by design:
- Your profile — display name, avatar, biography, genres, instruments and skills, portfolio links, ratings You have received, and Your approximate distance — is visible to other users, including users You have not connected with, when You appear in their match feed, search results, or recommendations.
- Chat messages are visible to the connection You send them to. Posts are visible to Your connections.
- Ratings and written feedback You leave are visible to the person You rated and contribute to the rating shown on their profile. Where You choose to submit feedback anonymously, We do not display Your name alongside it, but We retain a record of who submitted it and may disclose it where required by law.
- Jams You create, including their location, address, time, description, and image, and Your attendance at Jams, are visible to other users who can see that Jam.
Information You share with other users is outside Our control. Other users can copy, screenshot, save, or re-share what You send them or post. Deleting content, blocking someone, or deleting Your account removes it from Our Service, but cannot remove copies other people have already made. Please think carefully before sharing anything sensitive, and never share financial information, government identification, or passwords with another user.
We do not disclose Your email address, password, or push notification tokens to other users.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of our Service.
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

- To manage Your requests: To attend and manage Your requests to Us.
- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
We may share Your personal information in the following situations:
- With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.
- For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
- With other users: as described in the Information Visible to Other Users section above.
- With Your consent: We may disclose Your personal information for any other purpose with Your consent.
We do not sell Your personal information, and We do not share it with third parties for their own advertising or marketing purposes.
Service Providers We Use
We rely on the following third parties to operate the Service. They process personal data on Our behalf, under contract, and only for the purposes described here. Some of them are located outside Canada, which means Your information may be processed outside Your province or country.
- Cloudinary — hosting and delivery of profile avatars and Jam images.
- Mailgun — sending transactional email such as address verification and password reset messages. Receives Your email address.
- Sentry — error and crash reporting. Receives diagnostic data such as error messages, device and operating system information, and an identifier for the affected account, which helps Us fix problems.
- Expo and Google Firebase Cloud Messaging (and Apple Push Notification service on iOS devices) — delivering push notifications to Your Device. Receive Your push token and the content of the notification.
- Google Maps— displaying maps for setting Your location and for finding Jams. Map requests are subject to Google's own privacy policy.
- Our cloud hosting and database providers — running the servers and databases that store Your account and Content.
We do not use third-party advertising networks, and We do not embed third-party analytics or tracking software in the Application.
Legal Bases for Processing Your Personal Data
Where the General Data Protection Regulation (GDPR) or similar law applies to You, We process Your personal data on the following legal bases:
- Performance of a contract — to create and maintain Your account, provide matching, connections, chat, posts, Jams, and ratings, and otherwise deliver the Service You have signed up for.
- Your consent — for location information, access to Your camera and photo library, and push notifications. You can withdraw consent at any time in the Application or in Your Device settings, without affecting processing already carried out.
- Our legitimate interests — to keep the Service secure, prevent fraud and abuse, investigate reports and enforce Our Terms, understand how the Service is used, and improve it. We balance these interests against Your rights and freedoms.
- Legal obligation — to comply with the law, respond to valid legal process, and keep records We are required to keep.
- Vital interests — in rare cases, to protect the life or physical safety of You or another person.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
In practice, this means:
- Account and profile information is retained for as long as Your account is active, and is deleted when You delete Your account.
- Location coordinates are replaced each time they are updated, and are deleted as soon as You turn location sharing off or delete Your account. We do not keep a location history.
- Chat messages are retained for as long as the conversation exists. Please note that a conversation has two sides: when You delete Your account, the messages You sent may remain visible to the person You sent them to, in the same way as an email You have already sent. Messages are deleted for both parties when the connection between You is removed.
- Posts, Jams, and ratings are retained until You delete them or delete Your account. A rating You left about another user may be retained in anonymized form as part of their overall rating.
- Reports, blocks, and safety records are retained after account deletion where necessary to keep the Service safe, to enforce Our Terms, to prevent a banned user from returning, and to respond to legal claims.
- Crash and diagnostic data held by Our error reporting provider is retained on a rolling basis, typically for no more than 90 days.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.
Delete Your Personal Data
You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.
To delete Your Personal Data, please follow the instructions provided in the Account Removal Instructions page.
Our Service may give You the ability to delete certain information about You from within the Service.

You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.
Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Some limits apply. We may decline a request where the law permits, and We cannot delete information about You that is contained in another user's content, such as a message they received from You or a report they submitted about You, where deleting it would affect their rights or Our ability to keep the Service safe.
